On original submission we affirmed appellants conviction, holding that appellants "withdrawal" from his negotiated plea in the trial court, his subsequent trial and conviction by a jury, and the imposition by the trial judge of a sentence more severe than that originally imposed under the terms of the plea bargain, does not implicate North Carolina v. Pearce, 395 U.S. 711, 89 S. Ct. 2072, 23 L. Ed. 2d 656 (1969). After reconsideration of appellants contention, we abide by our original opinion. The motion for rehearing is denied.
